Welcome to mojn.dev (“Service”), operated by BoK ApS (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our product backlog refinement services that synchronize with Azure DevOps. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

mojn.dev provides a software-as-a-service platform that assists with product backlog refinement and synchronization to Azure DevOps. We reserve the right to modify or discontinue the Service at any time without prior notice.

3. User Obligations

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Compliance: You agree to use the Service in compliance with all applicable laws and regulations of Denmark and the European Union.
• Restrictions: You shall not misuse the Service by attempting to gain unauthorized access or transmitting any worms or viruses or any code of a destructive nature.

4. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

5. Fees and Payment

• Subscription Plans: Access to the Service may require a subscription fee. Details of the subscription plans and pricing are available on our website.
• Payment Terms: Fees are billed in advance and are non-refundable. You are responsible for any taxes applicable to your use of the Service under Danish law.

6. Cancellation and Termination

• Termination by You: You may cancel your subscription at any time. Upon cancellation, your access to the Service will continue until the end of your current billing cycle.
• Termination by Us: We reserve the right to suspend or terminate your account for violations of these Terms or any other policies.

7. Intellectual Property Rights

All content, features, and functionality on the Service—including but not limited to text, graphics, logos, and software—are the exclusive property of BoK ApS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Data Protection

We are committed to protecting your data. We will only use your data in accordance with our Privacy Policy, the Danish Data Protection Act, and the EU General Data Protection Regulation (GDPR).

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. BoK ApS disclaims all warranties of any kind, whether express or implied, regarding the Service.

To the fullest extent permitted by Danish law, BoK ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with your use of the Service.

13. Indemnification

You agree to indemnify and hold harmless BoK ApS and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by updating the “Last Updated” date at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under Danish law, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and BoK ApS regarding the use of the Service.
